If you fly in IDAHO please see the changes that were made on March 27 to SB 1134. The original bill exempted an “unmanned aircraft system used in the taking of commercial photography”. The bill was tabled but yesterday came back to life with some amendments, one of which removed the language above.
The final vote is likely on Monday April 1, 2013 when the Idaho House reconvenes.. This bill had been tabled in committee only a few days ago.
This is the problematic section
(2)(a) Absent reasonable, articulable suspicion of criminal conduct,
no person, entity or state agency shall use an unmanned aircraft system
to conduct unwarranted surveillance or observation of:
(i) An individual or a dwelling owned by an individual and such
dwelling's curtilage, without such individual's written consent;
(ii) A farm, dairy, ranch or other agricultural industry with-
out the written consent of the owner of such farm, dairy, ranch or
other agricultural industry. Provided however, that the restric-
tions on the use of unmanned aircraft systems provided for in this
subsection shall not apply to county sheriffs or other state or lo-
cal agencies engaged in search and rescue efforts and shall not ap-
ply to state and local law enforcement agencies engaged in lawful
activity.
(b) Absent reasonable, articulable suspicion of criminal conduct, no
person, entity or state agency shall use an unmanned aircraft system to
photograph an individual, without such individual's written consent,
for the purpose of publishing or otherwise publicly disseminating such
photograph.
Penalty are that the party may suit you for violating the law if passed.
